These terms govern your use of mimiwade.com and any order you place with us. Mimi Wade is operated by Maraschino Dreams Inc ("we," "us," "our"). By using this website or placing an order, you agree to these terms.

Orders

An order placed through our website is an offer to purchase. No order is accepted until we confirm acceptance and payment has been received. All orders are subject to availability, and we may decline any order without providing a reason. You are responsible for the accuracy of the details you provide, and you must be at least 18 years old, or have the consent of a parent or guardian, to place an order.

Products

Our pieces are produced in small runs, and the artisanal nature of the process means small irregularities are part of their character rather than defects. Colors may appear slightly different on your screen depending on your display. Sizes and measurements are approximate.

Pricing and payment

Prices are listed in US dollars and are the prices shown at the time your order is received. Applicable sales tax is calculated at checkout. Payment is charged at the time of purchase through the payment methods offered at checkout, and you confirm you are authorized to use the payment method provided. Title passes to you once payment is received in full. We will email you a receipt once the transaction is complete. We reserve the right to correct pricing errors and to cancel and refund any affected order.

Shipping

We dispatch orders within one week of receipt unless otherwise stated in the product description. Delivery estimates are approximate and we are not responsible for carrier delays once a parcel has left us. Risk of loss passes on delivery to the carrier.

International orders, customs and duties

We ship to most international destinations. Customs duties, import taxes and fees are set by the destination country and are your responsibility. Your carrier may contact you for payment before release, and delays may occur if these charges are not paid promptly. If charges are refused or left unpaid and the parcel is returned to us, we reserve the right to deduct return shipping, customs fees, duties and taxes from any amount refunded. Cancellations

If you wish to cancel an order, contact us as soon as possible. If it has not yet been dispatched, we will cancel and refund it in full. Once dispatched, the order is subject to our exchange policy.

Exchanges

We do not offer refunds on delivered orders. If you would like a different size, or another piece of equal or lesser value, we are happy to arrange an exchange provided the garment is returned in pristine, unworn and unwashed condition with all tags intact. Once we receive the piece we will inspect it, and where it meets these conditions you may exchange it or, at our discretion, receive a gift card to the value of the purchase. Exchanges are subject to a $20 restocking fee and the customer is responsible for return postage. To begin, email sales@mimiwade.com.

Intellectual property

All content on this site, including images, text, designs and the Mimi Wade name and marks, is owned by Maraschino Dreams Inc and may not be copied, reproduced or used commercially without our written permission.

Limitation of liability

To the fullest extent permitted by law, our total liability arising from any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law, and nothing affects your statutory consumer rights.

Governing law

These terms are governed by the laws of the State of California and the United States, and any dispute will be subject to the courts located there.

Changes

We may update these terms at any time. The version posted when you place your order applies to that order.
